Amendments to Regulation 6, Rule 3: Wood-Burning Devices were adopted by the Air District's Board of Directors at a public hearing on November 20, 2019:
The Air District is developing amendments to Rule 6-3 to further reduce fine particulate emissions from wood-burning activities when wildfire smoke impacts the Bay Area. Amendments to Rule 6-3 would allow the Air District to call a Spare the Air Alert year-round to notify the public when particulate matter is expected to exceed unhealthy levels. When a Spare the Air Alert is in effect, a Mandatory Burn Ban would prohibit the use of wood-burning devices, outdoor wood-burning devices, and recreational fires to protect the health of Bay Area residents. The Air District proposes to extend the wood-burning prohibition to ensure that high PM2.5 concentrations, such as those that occur during wildfire events, are not further exacerbated by wood-burning activities.
On September 23, 2019, the Air District released a Notice of Public Hearing. The hearing date has been moved to November 20, 2019. The Air District will release an updated Notice of Public Hearing on October 18, 2019. The deadline for comments on the proposed amendments remains unchanged; comments on the proposed rule amendments, staff report, and CEQA document are due by Wednesday, October 23, 2019.
At a public hearing on November 20, 2019, staff will present the final proposed documents for amendments to Rule 6-3 and CEQA analysis to the Air District Board of Directors for consideration.
The Air District released draft amendments to Rule 6-3 and a workshop report on July 1, 2019, and accepted comments on these materials through August 12, 2019. The Air District also hosted a public workshop on the draft amendments to Rule 6-3 and Regulation 5 on July 24, 2019.
