Official Rules
NO PURCHASE NECESSARY TO ENTER
1. Eligibility: giveaway is open to legal residents of California who live, or work within one of the nine counties that surround San Francisco Bay: Alameda, Contra Costa, Marin, Napa, San Francisco, San Mateo, Santa Clara, Southwestern Solano, and Southern Sonoma counties.
Participants must be at least 18 years old as of their date of entry in the promotion in order to qualify. Giveaway subject to federal, state, and local laws and regulations and void where prohibited by law. Employees of the Bay Area Air Quality Management District (“Sponsor”), its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), are not eligible to participate in the Campaign. The Campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
2. Agreement to Rules: By participating in the giveaway, the Participants (“You”) have affirmatively reviewed, accepted, and agreed to all of the Official Rules, and agree to abide by the Sponsor’s Official Rules and decisions, which are fully and unconditionally binding in all respects. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion.
3. Entry Period: Promotion begins (July 1, 2024) and ends (July 31, 2024) (“Entry Period”). To be eligible for the Giveaway, entries must be received within the specified Entry Period.
4. How to Enter: Eligible Participants can enter Giveaway by sharing a photo of their commute using an alternative to driving (taking public transit, walking, using active transportation, or carpooling), using the hashtag #STACleanCommute and tagging @sparetheair. If the participant’s social media account is set to private, they must send a copy of the post to @sparetheair via direct message on the platform it was shared to. Participants must also follow @sparetheair on the platform they post on. As a participant, your entry must fully meet all Giveaway requirements in order to be eligible to win a prize. Incomplete entries or those that do not adhere to the Official Rules or specifications will be disqualified at the Sponsor’s sole discretion.
Participating in the Giveaway involves Sponsor receiving and taking photographs, videos or motion pictures; or receiving videotapes, audiotapes, social media post, web casts, or other types of media productions that capture names, voices, and/or images (any of the foregoing types of media are called the “Materials”).
By entering a submission, You grant permission to the Sponsor to use, reuse, copy, publish, display, exhibit, reproduce, and distribute the Materials in any educational or promotional materials, on Sponsor’s website and social media pages, or other forms of media without notification. Participants agree to be identified by name in any material and are participating on a voluntary basis and understand they will not be compensated in any way for the Materials.
Entries must be original work and not violate anyone’s proprietary or intellectual property rights. You shall defend or settle against such claims at your sole expense, and You shall indemnify, defend and hold harmless the Sponsor from any suit as a result of infringing on anyone’s proprietary or intellectual property rights, rights to privacy, or other rights by which others may have a lawful claim against You.
You agree to not break any law throughout the course of your participation in the Giveaway. You must comply with all applicable local, state, and federal laws, and any illegal activity, violation of law, or activity the Sponsor determines in their full discretions as unsafe or hazardous will result in disqualification.
During the Giveaway entry period, you may submit one entry, and one entry only.
5. Prizes: The first 100 eligible Participants who enter the Giveaway will receive prizes mailed to their house. Prizes will be in the form of a $10 gift certificate to a business that will be determined by the Sponsor. Participants must agree to provide an address in order to receive a prize if selected to receive a prize in the Giveaway. The prize(s) shall be determined solely by the Sponsor. There shall be no cash or other prize substitution permitted. The prize is non-transferable. By accepting the prize, the You grant permission for the Sponsor to use your likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law.
6. Selection and Notification of Receiving a Prize: Participants will be notified via Direct Message of whether they have met all requirements to receive a prize.
The Sponsor is not responsible for and shall have no liability for Your failure to receive notices due to security settings that may cause notifications to be marked as spam or junk. Nor shall be Sponsor be liable for Your provision of incorrect or otherwise non-functioning contact information. If selected Participants 1) fail to claim the prize within five (5) days from the time the notification was sent, 2) is found ineligible for any reason, or 3) does not complete and return an address where prizes will be mailed within five (5) days of claiming any prize, the prize may be forfeited and an alternate Participant may be selected.
7. Terms & Conditions: In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate this Giveaway at any time.
8. Limitation of Liability: Your entry into the Sponsor’s Giveaway constitutes Your agreement to release and hold harmless the Sponsor and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in Giveaway and/or the 1) accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.
9. Governing Law: Any dispute that arises under or relates to this Giveaway shall be governed by California law. Venue for resolution of any dispute that arises under or relates to this Giveaway, including mediation, shall be San Francisco, California.
10. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the Sponsor’s website. Click here Privacy Policy (baaqmd.gov) to read the Privacy Policy.
11. Indemnification: By entering, You agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
By Entering Giveaway, You agree to indemnify and hold Sponsor, its officers, employees and agents harmless from and against any and all liability, loss, expense, including reasonable attorneys' fees, or claims for injury or damages relating to this Giveaway.
