Regulation 12 Rule 16: Petroleum Refining Greenhouse Gas Emissions Limits

Regulation 12, Rule 16 has been in development for several years. This past summer the California legislature enacted and Governor Brown signed, Assembly Bill 398, California Global Warming Solutions Act of 2006. Among its many provisions, this bill extends the Cap-and-Trade program from 2020 to 2030. Importantly this bill "prohibits air districts from adopting or implementing an emission reduction rule for carbon dioxide from stationary sources that are also subject to Cap-and-Trade."

After careful review of the language and legislative history of AB 398, the Air District has suspended further action on Regulation 12, Rule 16. The Air District will now focus attention on Regulation 11, Rule 18, which will help reduce toxic air contaminants from Bay Area facilities, and proceed with other regulatory programs to reduce GHGs from Bay Area stationary sources.

Hearings, Workshops and Other Events

Throughout the rule development process we provide information on upcoming and past workshops, hearings, and other events.

The Air District hosted scoping meetings in November 2016 to solicit public comment on the Notice of Preparation and Initial Study for Rule 12-16. A series of open house/workshop events was held in March 2017.

The Air District released proposed rule language and a regulatory package in March 2017. At its May 31, 2017, meeting, the Air District's Board of Directors directed Staff to revise the rule language to limit greenhouse gases, remove criteria pollutants limits, and continue the Public Hearing at the June 21 Board of Directors meeting. The Air District has released the revised proposed rule language and regulatory package.
